State cannot promote students final year exams will be held Supreme Court on pleas challenging UGC guidelines

Attention! The Supreme Court of India has mentioned that a state/Union territory can ask the University Grant Commission (UGC) to extend the exam deadline for final year exams. However, it cannot promote students on the basis of internal evaluation.

UGC released a set of guidelines on July 6, 2020, which made it mandatory for the universities to conduct final year examinations by September end, by any means, online or offline, or even in a blended format. The guidelines further stated that the students of the intermediate semester will be promoted on the basis of their past performance.

However, many students wanted UGC to cancel their final year exams also due to the ongoing Covid-19 pandemic. The petitioners have demanded that the final year students should also be evaluated using alternative methods as conducting exams is not feasible amid the ongoing pandemic and flood across the country.

The Supreme Court had previously observed that if the state disaster management authority has decided that the situation is not conducive for holding exams, can they overrule the UGC. To this, the apex court has mentioned that the decision taken by the state disaster management authority shall prevail over the UGC deadline. However, the decision to cancel and promote the students is beyond their jurisdiction.
